Two individuals have been arrested in connection with a BBC undercover investigation. The probe focused on immigration advisers allegedly assisting some asylum seekers in feigning a gay identity to remain in the country.
Coordinated raids in East London were conducted by the Criminal and Financial Investigations section of the Home Office’s Immigration Enforcement team.
Allegations of Fraudulent Asylum Claims
Last month, BBC News reported on how migrants with expiring visas were allegedly being advised on obtaining fraudulent evidence, such as fabricated supporting letters and photographs, to bolster their asylum claims. The investigation included secret filming at an event for LGBT asylum seekers, where several migrants reportedly informed an undercover reporter that the majority of attendees were not genuinely gay.
The Home Office subsequently announced an investigation into these allegations.
Arrests Made and Official Statements
According to a Home Office source, a woman in her late forties was arrested on suspicion of providing an immigration service in contravention of section 91 of the Immigration and Asylum Act. Concurrently, a man in his early twenties was arrested on suspicion of fraud.
Immigration Minister Mike Tapp, who was present during one of the raids, stated that such advice undermines the credibility of genuine asylum seekers’ claims. He asserted, “If lawyers, or so-called lawyers, and legal advisers are out there providing this dubious advice, we are pursuing them. And as you’ve seen today, we will make those arrests.” He added, “Our asylum system is designed for individuals genuinely fleeing persecution and war, and I am very proud of that. However, those attempting to abuse the system will not be tolerated.”
Political Reactions
Conservative Shadow Home Secretary Chris Philp commented, “A handful of arrests changes nothing while the underlying incentive remains intact.” He further stated, “The Conservatives would address this at its source by banning asylum claims from illegal arrivals, withdrawing from the ECHR [European Convention on Human Rights], and removing illegal arrivals within a week.”
Liberal Democrat spokesperson for immigration and asylum, Will Forster, remarked, “We need an asylum system that is fair, controlled, and efficient.” He emphasized, “Britain will proudly do its part in helping those genuinely fleeing persecution, but we will not tolerate abuse of the system.”
Green Party leader Zack Polanski had previously highlighted a broader issue of the government having “inconsistent policies,” which he believes create “perverse incentives for these kind of unscrupulous businesses and industries to emerge.”
Reform UK’s home affairs spokesman, Zia Yusuf, stated, “Labour can claim no credit for clamping down on lawyers aiding false asylum claims when they failed to act themselves.” He concluded, “Millions have entered this country illegally, and must be deported.”
